Online Application – 1-5.Lessees of National Real Estate Apply for Permission to Transfer the Lease Right

注意事項:

1、國有土地除適用耕地三七五減租條例之耕、養地租約之轉讓受特別限制(承租人因年邁體衰,得過戶換約由其同戶籍原共同耕作或養殖之直系血親卑親屬或家屬承租外,不得轉讓租賃權)外,其餘出租租約之承租人擬轉讓承租權時,應先徵詢出租機關同意。

2、於未徵得出租機關同意公文前,倘先行訂約轉讓者,依租約約定應支付當月租金額2倍之違約金。

3、承租人應於轉讓之日(已辦理所有權第一次登記之地上建築改良物為該建物登記謄本記載之登記日,其餘為訂立契約之日)起1個月內,會同受讓人向出租機關申請過戶換約。

4、國有房屋(地)租約租賃權不得轉讓及申請過戶換約。

5、本署轄區所屬分署或辦事處將於查處後,另行通知。

Please note:

1. The Lessees of the national land, unless applying for the transfer of farmland or aqua-cultural land lease contract subject to special restrictions under the 37.5% Arable Rent Reduction Act (the Lessees, unless transferring, due to old age and frailty, the ownership of the lease contract to the lineal blood descendants or dependents of the common household domicile who jointly cultivate or culture, shall not transfer the lease right), shall request permission for the transfer of the lease right from the leasing authority before transferring the lease right.
2. Where the Lessees make an agreement of transfer before receiving an official document of permission of transfer from the leasing authority, it shall pay a default penalty which is two times the monthly rent as required in the lease agreement.
3. The Lessees shall, within one month from the date of transfer (the registration date that records the transcript of the first registration of the ownership of the improvement as the building, otherwise it is the date of agreement engagement), shall apply, with the transferee, for the transfer of ownership with the leasing authority.
4. The leasing rights of the lease agreements of national houses (lands) shall not be transferred, and the transfer of ownership shall not be applied for. 
5. The Region Branch or Offices under the jurisdiction of the NPA will issue a notification accordingly upon investigation.
